PARTNERSHIP FIRM

It is also called Association of Persons (AOP), the Firm, and the Partnership.
Partnerships are governed in Pakistan under Partnership Act, 1932. It is very interesting to see that 80 year old law still exists in Pakistan. One reason of existence of such an old law is that it is very popular among businessmen. Another reason is that taxes on companies registered with SECP are higher than Partnership Firms.

When someone does not want to register its business with SECP and he also want to bring someone as partner then he should register his business as a Partnership Firm. However, this form of business doesn’t give you a protected business environment like company registered under Companies Act, 2017. The liabilities of partners are not limited in this form of business.

To register a firm, 2 or more partners are required. They sign an agreement on Rs. 1,000 stamp paper and record their consent before the registrar of firm. While giving their consent, the partners shall also present the following documents to the registrar:

Application Form of Registration of Firm.

  1. Rent agreement along with electricity bill of the office of the firm.
  2. An affidavit that the partners are not blacklisted by any court or government in Pakistan.
  3. CNIC copies of all partners.
  4. One witness in favour of each partner.
  5. Fees receipt of Rs. 1,000 paid in National Bank of Pakistan.

Remember that name of firm should not give an impression that it is associated with some local governmental or international organizations such as Ministry of Commerce, UNO of Punjab Govt.

It should not also use name of famous national and international brands because it may attract copyright violation laws and rules. Remember, copyright violation has become a serious crime nowadays.
